Les Proposition de Madrid

2007 թ. դեկտեմբերին Մինսկի խմբի համանախագահության անունից հակամարտող կողմերին ներկայացվեց Մադրիդյան առաջարկը, որի գաղափարախոսությունը միջազգային իրավունքի երկու սկզբունքների՝ տարածքային ամբողջականության եւ ազգերի ինքնորոշման ներդաշնակումն է։ Ինչ վերաբերում է կարգավորման էությանը կամ կոնկրետ ծրագրին, ապա այն բաղկացած է մոտավորապես հետեւյալ կետերից.

1. Հայկական ուժերի դուրսբերում Լեռնային Ղարաբաղին հարակից ադրբեջանական շրջաններից.
2. Այդ շրջանների վերաբնակեցում ադրբեջանցի փախստականների կողմից.
3. Ադրբեջանցի փախստականների վերադարձ բուն Լեռնային Ղարաբաղի տարածք.
4. Լաչինի միջանցքով Լեռնային Ղարաբաղի եւ Հայաստանի միջեւ ցամաքային կապի ապահովում.
5. Լեռնային Ղարաբաղի սահմանների շրջագծով միջազգային խաղաղարար ուժերի տեղակայում.
6. Ադրբեջանին վերադարձված տարածքների ապառազմականացում (դեմիլիտարիզացիա).
7. Ղարաբաղի եւ Հայաստանի արտաքին հաղորդակցության ճանապարհների ապաշրջափակում եւ հայ-թուրքական սահմանի վերաբացում.
8. Լեռնային Ղարաբաղի Հանրապետության միջանկյալ կարգավիճակի սահմանում.
9. Անորոշ ապագայում Ղարաբաղի վերջնական կարգավիճակի վերաբերյալ հանրաքվեի կամ ժողովրդական հարցման՝ պլեբիսցիտի անցկացում.
10. Հակամարտության գոտու վերականգնման համար միջազգային ֆինանսական օգնության հատկացում։

It is also beyond doubt that the Madrid proposal, which the Minsk Group gave to the parties in December, 2007, and which is based on the idea of reconciling two principles of international law – the right to national self-determination and the principle of inviolability of territorial integrity – will be the basis of the new proposal. As for the essence of the resolution or the specific program, it will consist of approximately the following points:

1.Withdrawal of Armenian forces from the Azerbaijani regions surrounding Nagorno-Karabagh;
2. Resettlement of these regions with Azerbaijani refugees;
3. Return of Azerbaijani refugees to the territory of Nagorno-Karabagh itself;
4. Provision of an overland link connecting Nagorno-Karabagh to Armenia through the Lachin corridor;
5. Deployment of peace-keeping forces on across the borders of Nagorno-Karabagh;
6. Demilitarization of the territories that have been returned to Azerbaijan;
7. Lifting of the blockade of Armenia’s and Karabagh’s external communications, and reopening of the Armenian-Turkish border;
8. Definition of an interim status for Nagorno-Karabagh Republic;
9. Conduct of a referendum on the final status of Nagorno-Karabagh in some undefined, future date;
10. Provision of international financial aid for the restoration of the conflict zone.

La proposition de Madrid, que le Groupe de Minsk a donné aux parties en Décembre 2007, et qui est fondée sur l'idée de concilier deux principes du droit international - le droit à l'autodétermination nationale et le principe de l'inviolabilité de l'intégrité territoriale.
Quant à l'essence de la résolution ou le logiciel, il sera composé d'environ les points suivants:

1.Retrait des forces arméniennes de l'Azerbaïdjan régions entourant le Haut-Karabakh;
2. La réinstallation de ces régions avec les réfugiés azerbaïdjanais;
3. Retour des réfugiés azerbaïdjanais dans le territoire du Haut-Karabagh lui-même;
4. Disposition d'un lien terrestre reliant le Haut-Karabakh à l'Arménie par l'intermédiaire du couloir de Lachin;
5. Le déploiement de maintien de la paix sur les forces au-delà des frontières du Haut-Karabagh;
6. La démilitarisation des territoires qui ont été retournés à l'Azerbaïdjan;
7. Levée du blocus de l'Arménie et du Karabakh communications externes, et la réouverture de-arménienne de la frontière turque;
8. Définition d'un statut intérimaire pour le Haut-Karabakh;
9. Conduite d'un référendum sur le statut final du Haut-Karabagh dans certains indéfini, date ultérieure;
10. Fourniture de l'aide financière internationale pour la restauration de la zone de conflit.

le principe l'inviolabilité de l'intégrité territoriale a été deja vilolé par USA, par Russie et par la France (Kosov, Abkhasie Osetie). la question aussi c'est quoi l'integrité territoriale ? d'etre integre avec quoi et a partir quel moment sur quel base.

pour eux l'integrité territoriale c'est la loi du plus fort (celui qui a les drams !!!!)

c'est de l'injustice.
